Years ago, I had a friend that backed off a roof, and his attorney kept having delays in getting it to court. So, he took the next route of suing his attorney for non-performance, and actually got a nice settlement.

Curious, who paid/basis for settlement? The roof owner for the fall or the lawyer for non-performance
 
The law firm paid. The court ruled he was due a settlement from the fall, but that the first firm failed to represent him in a timely manner. He was working in CA on a movie set and backed off the roof while holding a boom microphone.
